If server security is compromised, the account holder is responsible for all violations of the TOS and AUP, including SPAM, and all disconnect and reconnect fees associated with violations.

These are the detailed terms of service for hosting and servers only.
Summary - This is free speech webhosting for websites like forums, communities, download sites, etc. There are few content restrictions and all is in accordance with laws and regulations of The Netherlandss & Romania. There is no leeway on the rules that we do have, proper procedure is first to contact you for warning, second to suspend your site, third time - account termination. Do not sign up if you plan to do anything against the rules, we do check these things and we wil know, do not waste ours and your time by signing up if you thnk you will be able to sneak by us and break the terms.
Regarding the DMCA complains, we forward them to you and you decide how to proceed next.
You can host anything on our servers except :
* Scam Sites (ex: Ebay/Paypal,CC/Password Scam sites)
* Mailbombers or any sort of spam sites
* Phishing Sites
* Child Porn Sites
* Spam email
* Netscan / Hack programs and archives
* Malicious Scripts (ex: originate DDoS attacks or hack attempts)
* Botnet/Doorway/Carding
* Anything than can result in Spamhaus listing
Use of AlibabaHost [Brand Of "Nix Web Solutions Pvt Ltd"] Service constitutes acceptance and agreement to AlibabaHost's policies are subject to the terms above and as follows:
Establishment of service is reliant upon receipt by the Company of payment of affirmed charges. Following payments are due on the anniversary date of the month for that month's service. If you fail to pay on the day due your service with AlibabaHost will be suspended for 7 days. On the 7th day once the account has been passed 0:00AM GMT your account will terminated with a concerned terminated notice. If your are away for a holiday, business meetings away from the PC unable to pay. Please do advise us before the actions happend so we can sort out a matter. If this matter has not been told there is no excuse at all. This is your responsibility.
Payments and Fees:
Accounts that reach 7 days past due will be suspended and will be added a late fee of ₹100 to recover your service online. Accounts that are not collectable by AlibabaHost may be turned over to an outside collection agency for collection. If you desire to cancel your account, please follow submit a ticket into the Billing Department before 7Days of day of due.
Failure to Pay:
AlibabaHost will terminate your service after the 7th day of suspension. We could deny service or terminate this Agreement upon the failure of Subscriber to pay charges when due. Such termination or denial will not relieve Subscriber of responsibility for the payment of all accrued charges, plus reasonable interest and any collection fees.
Requests for canceling accounts has to be made through the helpdesk system.
AlibabaHost 's method of cancellation is via the helpdesk of your Hosting account. Please log into the helpdesk and you can request to have your account cancelled. We need a notice before 7 days at all times. If seven days has past this is your responsibility and will need to take further action from our billing department.

Our cancellation policy is very simple - if you cancel your hosting account we will provide you with a refund via online mode [Bank Transfer] within 15 days for the remainder of the term. The refund will exclude any setup fees that were charged when you signed up and any domain registration fees that you paid as we incur a cost for these. But you do get to keep your domain name.
If we register a domain name for you as part of your hosting package with us, and you decide that you want to cancel your account, then we will deduct the cost of the domain name from the money we refund you. We will then be able to release the domain after the standard 60 days so you are free to take it elsewhere. During those 60 days you can change your name-servers to point elsewhere so you can still access your website.
Verbal abuse, threatening to any of our staff members will be a ground for immediate termination of accounts & services without refunds.
We reserve the right to cancel or terminate your account at any time and for any reason. It is your full responsibility to create back ups of your website, including files, e-mail accounts, databases and so on.

AlibabaHost will not issue refunds to users who have their account terminated by AlibabaHost, for breach of our terms of service.

In addition AlibabaHost shall have the right to terminate all service set forth in this Agreement without any consent.
AlibabaHost, provides technical support to our subscribers and our staff is limited to our area of expertise.
The following are our guidelines when providing support:
AlibabaHost does not offer tech support for application specific issues such as cgi programming, html or any other such issue.
AlibabaHost takes a zero percent tolerance approach to the sending of Unsolicited Commercial Email (UCE) or SPAM over our network. Very simply this means that customers of AlibabaHost may not use or permit others to use our network to transact in UCE. Customers of AlibabaHost may not host, or permit hosting of, sites or information that is advertised by UCE from other networks. Violations of this policy carry severe penalties, including termination of service.
Violation of AlibabaHost's SPAM policy will result in severe penalties. Upon notification of an alleged violation of our SPAM policy ,AlibabaHost will initiate an immediate investigation (within 48 hours of notification). During the investigation, AlibabaHost may restrict and a suspension will occur, customer access to the network to prevent further violations. If a customer is found to be in violation of our SPAM policy, AlibabaHost may, at its sole discretion, restrict, suspend or terminate customer's account without any consent given. Further, AlibabaHost reserves the right to pursue civil remedies for any costs associated with the investigation of a substantiated policy violation. AlibabaHost will notify law enforcement officials if the violation is believed to be a criminal offense.
As our Customers are ultimately responsible for the actions of their clients over the AlibabaHost network, it is advisable that customers develop a similar, or stricter, policy for their clients.
System and Network Security:
Users are prohibited from violating or attempting to violate the security of the AlibabaHost Network. Violations of system or network security may result in civil or criminal liability. AlibabaHost will investigate occurrences, which may involve such violations and may involve, and cooperate with, law enforcement authorities in prosecuting Users who are involved in such violations. These violations include, without limitation:
Accessing data not intended for such User or logging into a server or account, which such User is not authorized to access.
Attempting to probe, scan or test the vulnerability of a system or network or to breach security or authentication measures without proper authorization.
Attempting to interfere with service to any user, host or network, including, without limitation, via means of overloading, "flooding", "mail bombing" or "crashing".
Forging any TCP/IP packet header or any part of the header information in any e-mail or newsgroup posting.
Notification of Violation:
AlibabaHost is under no duty to look at each customer's or user's activities to determine if a violation of the TOS has occurred, nor do we assume any responsibility through our TOS to monitor or police Internet-related activities.
Miscellaneous Provisions:
You must provide us with, and keep current, good contact information for you. E-mail, fax, and telephone contacts are used. If you have any false information given while ordering or account ordered. Your account will be refunded or a account suspension given untill further notice.
AlibabaHost takes no responsibility for any material input by others and not posted to the AlibabaHost Network by AlibabaHost. AlibabaHost is not responsible for the content of any other web sites linked to the AlibabaHost Network; links are provided as Internet navigation tools only. AlibabaHost disclaims any responsibility for any such inappropriate use and any liability to any person or party for any other person or party's violation of this policy.
AlibabaHost is not responsible for any damages your business may suffer. AlibabaHost does not make implied or written warranties for any of our services. AlibabaHost denies any warranty or merchantability for a specific purpose. This includes loss of data resulting from delays, non-deliveries, wrong delivery, and any service interruptions caused by AlibabaHost. It is your RIGHT to backup your data at all times. We do not take any right to backup data, If a dataloss occurs on one of AlibabaHost VPS Nodes. We are not at fault at any cost. You have 100% righ to backup your data at all times.
It is absolutely forbidden to IRC servers on. Accounts found hosting this material will be subject to immediate cancellation with account termination without refund.
If for any reason (except for scheduled downtimes) our network or servers are down for longer than 0.5% in any month, you can request a 10% discount for your following month's services. For clients paying yearly, the equivalent to 20% of a monthly payment will be deducted off the next payment.

A cancellation fee may be needed for your account to be unsuspended. If your "Account Holder" does pay the cancellation fee your account may be provisioned as terminated within 7days.
Your use of this service is at your sole risk. Our backup service is provided to you as a courtesy. AlibabaHost is not responsible for files and/or data residing on your account. You agree to take full responsibility for files and data transferred and to maintain all appropriate backup of files and data stored on AlibabaHost's servers.
You, as AlibabaHost's customer, are solely responsible for the content stored on and served by your AlibabaHost server.
We will not be held responsible for any damages your business may suffer. We make no warranties of any kind, expressed or implied for services we provide. We disclaim any warranty or merchantability or fitness for a particular purpose. This includes loss of data resulting from delays, no deliveries, wrong delivery, and any and all service interruptions caused by us or our employees.
